And I would agree you should have been told all this when buying the car, frankly when you were considering the car. I back you 100% on this, and back in December I also pointed you towards at best it being a dealer issue not a Volvo one. While I am careful to disclose such things to my customers, if you asked me if I thought it would be a surprise that many would not, well of course it wouldn’t shock me. We simply don’t know the language used by either yourself, the sales person, or anyone else involved in the signing. IMO it would depend very much on the integrity of those involved at the dealer, but it also is equally believable that you were told and didn’t understand. For example, I did tell you all this was likely the case on December 5th and you responded to my post. So to say you didn’t know about this concern until recently is not correct (though you haven’t made that claim, but the delay in the follow up post on the topic is interesting). You could have forgotten or misunderstood, but yeah, that would paint a picture that makes it more believable that the dealer told you at some point and you missed it as well.

The evidence that will be at play is the paperwork, and every buyers order I’ve ever seen has a box to mark it new or used. It 100% should have been used because of when it was sold… however, there is a chance they made a mistake and it was new on the form, that would of course greatly aid your case. If you signed a title rather than an MSO that could play a role, no new cars have titles. It likely was still listed on the new cars on their website, but the challenge there is that so are loaner cars listed as new as well and they also have an in service date prior to sale. Still, it might be a place you could make a stand. Most websites give a clause for mistakes. And likewise, they could have had it marked as a loaner/demo as our store would have done, which would have ended up being another point of communication. Not sure if there is a good way to track that information one way or the other.

You said it was payback for Volvo’s sunroof drain issue in so many words. So regardless of any agency or anything else of which I’m ignorant about… that is a Volvo problem. If you’re making the dealer face payback, you’re literally targeting the wrong entity. So yeah, I think people need to focus on single issues at a time rather than to combine them. But google, a very reliable legal source, suggests that dealers are not agents of manufacturers these days, which matches my own understanding (though again, I don’t pretend to be legally knowledgeable). Though I will leave the legal thinking to yourself. Volvo sets the in service date when the car is reported sold by the dealer. As I told you before, that would have happened in September.

And that’s where you and I are at extreme odds. Volvo did nothing wrong at all in any way in this matter. So even the language that Volvo owes you something for misrepresentation or fraud is an impossible suggestion to me. You could say the dealer needs to make good on it and cover you for that month or whatever it is, but Volvo simply isn’t a player here. So I find myself pushing back against your claims rather than trying to fully help because you insist on the injustice of attacking the innocent entity. All you have to do is focus on the dealer and it’s a whole different perspective for myself.
